These Terms of Service govern purchases made through OpsReady Store and the use of OpsReady digital products.

By placing an order, you agree to these terms.

Nothing in these terms affects any rights that cannot legally be excluded or restricted.

Our products

OpsReady provides digital business, compliance, safety and operational resources, including:

  • templates;
  • policies;
  • checklists;
  • registers;
  • training materials;
  • risk-assessment resources;
  • spreadsheets;
  • forms; and
  • guidance documents.

The exact contents of each product are described on the relevant product page.

Unless a listing specifically states otherwise, all products are supplied digitally and no physical product will be posted.

Orders and payment

You are responsible for providing accurate information when placing an order.

An order is subject to:

  • successful payment;
  • fraud and security checks;
  • product availability;
  • obvious pricing or listing errors; and
  • technical availability of the digital-delivery system.

If we need to cancel an order after payment has been taken, an appropriate refund will be issued.

Digital delivery

Digital products are normally made available electronically after successful payment.

You are responsible for:

  • providing a valid email address;
  • maintaining access to your email account;
  • having suitable internet access; and
  • having software capable of opening the file formats stated in the product description.

Cancellation rights

Digital content is subject to specific cancellation rules.

Where required by law, before immediate supply of digital content begins you may be asked to:

  • expressly consent to supply beginning during the statutory cancellation period; and
  • acknowledge that your right to cancel may be lost once supply begins.

Licence to use OpsReady products

Unless a product page specifically states otherwise, purchasing an OpsReady product gives you a:

non-exclusive, non-transferable licence

to use and adapt the product for the internal purposes of the purchasing business or organisation.

You may:

  • download and retain purchased files;
  • edit documents supplied in editable formats;
  • add your own business name and logo;
  • adapt documents to your own procedures;
  • print documents for internal use;
  • provide relevant documents to your employees, workers and contractors where required for legitimate internal business purposes.

Prohibited use

Unless we give prior written permission, you must not:

  • resell an OpsReady product;
  • redistribute the original templates to unrelated third parties;
  • share a purchased pack with another unrelated business;
  • upload OpsReady files to another marketplace or file-sharing platform;
  • reproduce the files for resale;
  • claim the original OpsReady product as your own commercial work;
  • use the files to create a competing commercial template pack; or
  • remove or misuse OpsReady branding or intellectual-property notices where applicable.

Consultants and multi-client use

A standard purchase is intended for use by one purchasing business or organisation.

Consultants wishing to use OpsReady templates across multiple unrelated client businesses should contact us regarding appropriate licensing.

Intellectual property

Unless otherwise stated, intellectual-property rights in OpsReady products, including original written content, document structures, designs, layouts and branding, belong to OpsReady Group Ltd or are used under appropriate rights.

Purchasing a product gives you a licence to use it in accordance with these terms. It does not transfer ownership of the underlying intellectual property.

Compliance products

OpsReady products are designed to support practical business and compliance management.

Every organisation is different.

You are responsible for reviewing and adapting the documents to reflect your own:

  • premises;
  • activities;
  • equipment;
  • employees;
  • contractors;
  • hazards;
  • risks;
  • procedures;
  • management arrangements; and
  • applicable legal and regulatory requirements.

No guarantee of regulatory approval

Purchasing or using an OpsReady product does not guarantee:

  • full compliance with every requirement applicable to your organisation;
  • approval by a regulator or enforcement authority;
  • a successful inspection or audit;
  • prevention of accidents or incidents; or
  • avoidance of enforcement action.

Not legal advice

Unless specifically stated otherwise, OpsReady products and website content are practical business and operational resources.

They do not constitute legal, financial or other regulated professional advice.

Where necessary, you should seek advice from an appropriately qualified professional.

Customer responsibility

You are responsible for:

  • reviewing documents before using them;
  • completing templates accurately;
  • adapting documents to your business;
  • keeping records and procedures up to date;
  • carrying out appropriate risk assessments;
  • complying with relevant legislation and official guidance; and
  • ensuring employees receive appropriate information, instruction, training and supervision.

Product updates

We may revise or improve products over time.

Unless the product page specifically states otherwise, a purchase does not automatically include:

  • every future version;
  • every updated edition;
  • future jurisdiction-specific editions; or
  • replacement products released at a later date.

Product descriptions and compatibility

We take reasonable care to describe products accurately.

Minor formatting differences may occur depending on:

  • software;
  • operating system;
  • printer settings;
  • fonts;
  • devices; or
  • document-viewing applications.

Please check the stated file formats before purchasing.

Problems with digital products

If you receive a file that is missing, corrupted, inaccessible or materially different from the product purchased, please contact us.

We will normally try to resolve the problem by providing a corrected or replacement file.

Your statutory rights are not affected.

Limitation of liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

This includes liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • statutory rights that cannot legally be excluded.

Subject to those rights, OpsReady is not responsible for losses arising solely because a customer:

  • failed to review a document;
  • failed to adapt it to their circumstances;
  • used outdated information;
  • ignored relevant legislation or official guidance; or
  • implemented a template incorrectly.

Privacy

Personal information is handled in accordance with our Privacy Policy.

Marketing communications can be unsubscribed from at any time.

Third-party services

Our store may rely on third-party services, including Shopify, payment providers and digital-delivery providers.

Use of those services may also be subject to their own terms and privacy notices.

Changes to these terms

We may update these Terms of Service from time to time.

The version published on the website at the time of your purchase will normally apply to that purchase.

Governing law

These Terms of Service are governed by the laws of England and Wales.

Consumers may also benefit from mandatory legal protections that apply in the country where they live.
